2.Purpose

These general terms & conditions govern all purchases of Gardner87 products, whatever the channel through which the purchase is made.

The registration of the customer account and/or the finalization of the payment fully validates the acceptance of these general conditions of sale when the purchase is made online.

In all cases, the acceptance of a commercial offer and/or the signing of an order form and/or the payment of the bike leads the full and explicit acceptance of Gardner87 General Terms & conditions.

The products available on Gardner87 website can be ordered directly from the site www.Gardner87.com, by email sales@Gardner87.com, or by phone on +377 (0) 377 090 87.

In case of online purchase, the bikes are sold pre-assembled and accompanied by their user manual. The final assembly, which must be done as specified in the user manual with the tools provided, as well as the final inspection of this assembly, are the responsibility of the purchaser.

The user manuals as well as introductory videos, can also be consulted on the website www.Gardner87.com.

All spare parts and accessories must be installed by a qualified specialist according to the Gardner87 specifications. Gardner87 cannot be held liable for any damage caused by incorrect assembly or incorrect installation.

3.Price and payment terms

In case of online purchase, the product price is indicated on the website alongside the description of the product itself. The prices stated include VAT (20%) and exclude the cost of delivery, which shall be borne by the customer if outside the EU. Unless different payment conditions stated in the quotation or commercial offer from Gardner87, the terms of payment are full payment upon placing your order. Goods will only be shipped upon full payment of the purchase price.

Delivery costs (for outside EU) are calculated automatically according to the country to which the product is delivered, and will be added to the total cost of your purchase. These additional costs will be clearly displayed and included in the total of your order. Gardner87 reserves the right to modify the product price and to update the delivery costs at any time and without notice. The prices will then be immediately updated on the Gardner87 website.

In case of sale of products to a retailer, the price and payment conditions will be stated in the Gardner87’s commercial offer.

In all cases, the transfer of ownership takes place upon full payment of the product.

4.Orders

Orders placed on Gardner87 website must be confirmed by Gardner87 to be a delivery commitment. Confirmation of the receipt of your order will be automatically sent out once the order is placed. This does not constitute acceptance of your order. You will receive within ten (10) days of the receipt of the order a confirmation by email of the order, either total or partial, along with the associated delivery period. This order confirmation defines the applicable purchase order.

5.Delivery

Excepted specific conditions specified in the order confirmation, the Product will be usually shipped within fifteen (15) days from full payment receipt. Even though we make our best effort to meet the announced deadline, the delivery times are only given as an indication, and are likely to change in case of problem with the transporter or supplier.

Purchaser is required to check the condition of the product(s) upon delivery and to notify to the carrier by written, on the delivery slip, any damage observed.

No return will be accepted for breakage or deterioration of the product if such has not been reported to the carrier who delivered, and if you have not recovered a photocopy, or a photo or any other copy indicating the cause of the rejection.

The purchaser must also inform Gardner87 thereof within a maximum of seventy-two (72) hours. After this period, the delivery and the product shall be deemed compliant.
Gardner87 cannot be held liable for any delay or non-delivery due to the unavailability of the Customer for receiving the Product(s), to unforeseeable circumstances or to force majeure event. In case of delay, we shall inform you by email and the product will be dispatched as soon as possible once the circumstances that have generated this delay no longer apply.
For deliveries made outside the European Union, purchaser will be considered to be importer of the product. All duties import taxes or additional customs clearance costs shall be borne exclusively by the purchaser.

6.Shipping document and receipt

You will receive a delivery note indicating all the information relating to the order. We must keep carefully this document, which represents the proof of your ownership, in particular for any subsequent problem linked to the warranty or for any complaint, and for insurance purposes in the event of your bike being lost or stolen.

7.Returns and reimbursements policies

If you have bought one or more products for your personal use as a consumer and you wish to exercise your right of withdrawal from the sales contract and return the product(s), you have the right to cancel the order in writing, except for customized products, within fourteen (14) working days from the date of receipt of the goods, without penalty and without giving any reason. You shall bear costs linked to returning the product(s).
If you wish to exercise your cancellation right, the product must be returned to the address of the Gardner87 head office within a maximum period of fourteen (14) days of exercising said right. The product must be unused, carefully protected in its original packaging, complete (accessories, manual, etc.), and accompanied by a copy of the delivery note or invoice. Any product returned damaged will give rise to partial reimbursement to compensate the necessary repairs.

In the case of sales to professional, once confirmed by Gardner87, the order is firm and binding for the purchaser, who shall remain under all circumstances liable for payment of the full price of the order.

8.Product warranty

Gardner87 bikes are guaranteed for five (5) years for the stem, hanger and seatpost and two (2) years for all other parts, from the date of delivery, except for wear parts, which should be replaced as recommended in the user manual.

The validity of the warranty is subject to a strict compliance with the provisions contained in the user manual. Likewise, failure to respect the instructions for use, maintenance, and replacement of wear parts, and any nonconforming or inappropriate use of the product, will lead to a cancellation of the present warranty.

9.Intellectual property

The content of the site Gardner87.com, these general terms & conditions, the visuals, layouts, infographics namely, remain the exclusive property of Gardner87. Any partial or total reproduction of the site and its content is strictly prohibited.

10. Personal data

The customer of Gardner87 has a right of permanent access, rectification and opposition with regard to information relating to him.

11.GPS tracker and ebike

This model can be fitted with a GPS tracker that you need to configure using the mobile app . If the owner must subscribe, then it is at its own expense, a contract with the company or with any other operator of their choice.

12.Applicable law and/competent jurisdiction

Relationship between Gardner87 and the Customer shall be governed by the laws of Monaco. In the event of any dispute, the competent court of the Principality of Monaco will have sole and exclusive jurisdiction.

13. Intellectual Property

All Site content and trademarks are our property or licensed to us. Any reproduction, distribution or modification is prohibited without prior consent.
